A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF INGLEWOOD, CALIFORNIA

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF INGLEWOOD, CALIFORNIA, DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN STREET LIGHTING ASSESSMENT DISTRICT NO. 1980-1 FOR FISCAL YEAR 2025-2026, AND APPOINTING A TIME AND PLACE FOR A PUBLIC HEARING

WHEREAS, the City Council has by resolution initiated proceedings for the levy and collection of assessments for the services and improvements for Street Lighting Assessment District No. 1980-1 (“District”) for the Fiscal Year commencing on July 1, 2025 and ending on June 30, 2026 (Fiscal Year 2025-2026); and

WHEREAS, the City Council has ordered and received an Engineer’s Report for the District for Fiscal Year 2025-2026, which has been filed with the City Clerk pursuant to the Inglewood Improvement District Procedural Ordinance, codified at Inglewood Municipal Code (IMC) sections 10-130 through 10-148.4;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF INGLEWOOD DOES RESOLVE AS FOLLOWS:

SECTION 1.  The foregoing recitals are true, correct, and incorporated herein.

SECTION 2.  The City Council finds that the services and improvements, and the levy and collection of assessments related thereto are in the public interest and convenience, and benefit of the property owners within the District.

SECTION 3.  The City Council declares its intention to order the District services and improvements, and to levy and collect assessments against the lots and parcels of land within the assessment district designated as Street Lighting Assessment District No. 1980-1, pursuant to the Inglewood Improvement District Procedural Ordinance, for Fiscal Year 2025-2026, to pay for the following costs and expenses of the services and improvements:

(a)       District Lighting improvements and services include, but are not limited to, the maintenance, operation, and incidental expenses related to removal, repair, replacement, or relocation of light standards, poles, bulbs, fixtures and appurtenances.

(b)       District landscaping improvements and services include, but are not limited to, watering, fertilizing, mowing, weed control, shrubbery and tree pruning, removal and replacement of dead growth, and maintenance of irrigation facilities.

(c)       No substantial changes in services or improvements are proposed for Fiscal Year 2025-2026.

SECTION 4.  The assessments for Fiscal Year 2025-2026 are apportioned according to the method identified in the Engineer’s Report and are not proposed to increase from the assessments approved and ordered for the previous fiscal year.

SECTION 5.  The boundaries of the District are coterminous with the boundaries of the City of Inglewood.

SECTION 6.  Public property owned by any public agency and in use in the performance of a public function, which is included within the boundaries of the District, shall not be subject to the assessment herein.

SECTION 7.  Reference is hereby made to the Engineer’s Report entitled “City of Inglewood, Street Lighting Assessment District No. 1980-1, Fiscal Year 2025-2026, Engineer’s Report.”  Said Report has been prepared and submitted under a single cover and is on file in the Office of the City Clerk, and provides a description of the services and improvements, the boundaries of the District, and any Zones therein, and the proposed assessment rates upon lots and parcels of land within the District.

SECTION 8.  Pursuant to IMC section 10-145.5, notice is hereby given that on the 15th day of July 2025, at 2:00 PM, a public hearing will be held in the Council Chambers of City Hall, One Manchester Boulevard, Inglewood, California 90301, regarding Street Lighting Assessment District No. 1980-1 for Fiscal Year 2025-2026.  The public hearing will afford interested persons the opportunity to hear and be heard.

Any interested person may file a written protest with the City Clerk prior to the conclusion of the public hearing. A written protest shall state all grounds of objection. A protest by a property owner shall contain a description sufficient to identify the property owned by the signer thereof. The City Council shall consider all oral statements and written protests made or filed by any interested person.

Following such public hearing the City Council shall consider and may take actions regarding the assessments for Fiscal Year 2025-2026.

            SECTION 9.  The City Clerk is authorized and directed to give notice of such public hearing as provided by law.

SECTION 10.  The City Clerk shall certify to the adoption of this resolution and the same shall be in full force and effect immediately upon adoption.

SECTION 11. The City Council hereby determines and declares that the proposed assessments constitute a continuation of assessments existing on the effective date of Article XIIID, that the assessments are imposed exclusively to finance the maintenance and operation expenses for streets and that the assessments as presented are exempt from the requirements of Article XIIID, Section 4 of the California Constitution.
